On October 22, 2012, Senator Baules appeared with his lawyer, Siegfried Nakamura, before Judge Materne as the result of the Government’s issuance of two penal summons for: (1) a criminal assault and battery case for the alleged attack on Kenheart Andrew with a metal chair; and (2) a revocation case for an alleged violation of his probation for the same offense. A $10,000 surety bond was set and the matter was continued for a status hearing on October 26, 2012 at 9:00 a.m.
As a condition of his release, Senator Baules has been instructed to “stay away” from the Did Ra Ngmatel -Blue Bay – gas station where the alleged offense occurred and to stay away from the potential witnesses who were present at the time of the alleged offense.
It is likely that these matters will not be resolved by the Court before Palau’s General Election in which Senator Baules is seeking re-election.
